A man in his 30s who committed dating violence—including assaulting and threatening his girlfriend out of suspicion of infidelity, forcing her to write a written oath, and filming her naked—has been sentenced to prison.
The Jeju District Court Criminal Division 3 sentenced the man in his 30s, identified as A, who was indicted without detention on charges including violation of the Act on Special Cases Concerning the Punishment of Sexual Crimes, to 1 year and 8 months in prison and ordered him taken into court custody.
The court also ordered him to complete 40 hours of a sexual violence treatment program.
A is accused of assaulting his girlfriend, B, multiple times on January 28, 2023, suspecting her of cheating. He allegedly forced her to kneel in the nude, compelled her to write an oath stating "I will give away all my assets if I cheat again," and filmed the process with his cell phone.
He is also accused of taking B's cell phone and deleting all of her contacts and photos.
A's side largely denied the charges, claiming that B wrote the oath voluntarily and that he had never filmed a video.
However, the court stated, "The victim's statements are credible, as they are too specific to have been fabricated without direct experience."
The court explained that the submitted evidence, such as photos of B's bruises taken immediately after the incident, related counseling records, and phone call contents with her younger sibling, consistent with the victim's testimony.
The court rebuked him, saying, "The severity of the assault is not light, and he filmed a scene that would cause extreme humiliation."
It added, "It is evident that the victim suffered severe psychological distress, and she has not forgiven him," and noted, "The possibility of punishment is not reduced simply because they continued their relationship for a considerable period after the crime."
Both the prosecutor and the defendant A appealed the first-instance ruling.
