Man Jailed for Dating Violence Including Forced Nudity and Filming

A man in his 30s has been sentenced to prison for dating violence, which included assaulting and threatening his girlfriend, forcing her to write a pledge, and filming her naked under the suspicion that she was unfaithful.

Jeju District Court Judge Shin Jae-hwan, presiding over Criminal Single Division 3, sentenced the man in his 30s, identified as A, to one year and eight months in prison on charges including violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes, and ordered him taken into custody in court.

The court also ordered A to complete 40 hours of a sexual violence treatment program.

A is accused of assaulting his girlfriend B multiple times on January 28, 2023, suspecting her of cheating, forcing her to kneel naked, compelling her to write a pledge stating she would "hand over all assets if she cheated again," and recording the process on his cell phone.

He is also charged with confiscating B's cell phone and deleting all of her contacts and photos.

A and his legal team largely denied the charges, claiming that B wrote the pledge voluntarily and that no video was ever recorded.

However, the court stated, "The victim's statement is detailed to an extent that would be difficult to fabricate without direct experience," adding, "The victim's testimony is credible."

The court explained that submitted evidence, such as photos of bruising on B's body taken immediately after the incident, related consultation records, and phone call contents with her younger sibling, consistent with the victim's statements.

The court rebuked A, stating, "The severity of the assault is not light, and he filmed a scene that would cause extreme humiliation."

It further noted, "It is evident that the victim suffered severe psychological distress, and she has not forgiven the perpetrator," adding, "The fact that they continued their relationship for a considerable period after the crime does not diminish the possibility of punishment."

Both the prosecutor and the defendant A have appealed the first-instance verdict.
