A ruling has been finalized upholding the Ministry of Justice's decision to issue a three-month suspension to former Senior Prosecutor Kim Sang-min, who publicly expressed his intention to run in the general election while still in office.
On the 3rd, former Prosecutor Kim withdrew his appeal against the appellate court ruling that had dismissed his lawsuit seeking to cancel the suspension.
Previously, in September 2023 while still holding prosecutor status, Kim sent text messages to residents of his hometown, Changwon in South Gyeongsang Province, suggesting his candidacy for the 22nd general election with statements such as "I am a Changwon person to the bone" and "I will give great hope and goals to the local community."
In response, the Ministry of Justice's Disciplinary Committee issued a three-month suspension to former Prosecutor Kim in February 2024.
A month after receiving the disciplinary action, in March 2024, former Prosecutor Kim resigned and registered as a preliminary candidate for the People Power Party in the Uichang District of Changwon, South Gyeongsang Province, to run in the 22nd general election, but he was cut off.
Former Prosecutor Kim filed an administrative lawsuit to contest the Ministry of Justice's disciplinary action. However, in February of last year, the first instance court ruled that the disciplinary action was justified, and the second instance ruling issued in June of this year reached the same conclusion.
Meanwhile, former Prosecutor Kim was finalized with a prison sentence with probation by the Supreme Court last month on charges including handing over an expensive painting to Kim Keonhee in exchange for nomination favors.
