A man in his 50s, who was imprisoned for assaulting a female entertainment establishment owner and later paroled, has been sent back behind bars after threatening the past victim once again.
The Gwangju High Court dismissed the appeals filed by both the prosecutor and the defendant in the appeal trial of the 55-year-old defendant, identified as A, upholding the lower court's sentence of one year in prison.
Defendant A was indicted on charges including retaliatory intimidation after visiting a pub located in Deokjin-gu, Jeonju, Jeollabuk-do around 6:25 PM in November of last year and threatening the female owner, B.
A had previously beaten B, received a sentence of one year and eight months in prison, and was paroled in May of last year while serving his term.
As soon as his parole period ended, harboring a grudge over being reported, A visited B's business establishment.
At the time, he said, "I have something to say. Shouldn't we make peace?" but B avoided him, saying, "Don't come to our shop anymore. I'm scared."
It was confirmed that A then glared at B and threatened her by saying, "Watch your neck from now on."
He denied the crime, claiming, "Since the victim had gained some weight, I just told her to 'take good care of your body,' and I did not threaten her."
However, following the first instance, the appellate court also concluded that the threatening remarks heard by B were indeed made.
The appellate court explained, "From the investigative agency to the court, the victim has consistently and specifically stated the occurrence of the incident, the circumstances before and after, as well as the defendant's words and actions."
It added, "The defendant visited the victim during the repeat-offense probation period and committed retaliatory intimidation once again, making his culpability heavy," thereby stating the reasons for dismissing the appeal.
