Research officers from the Constitutional Court visited the Air Force Aviation High School on October 15 to review a constitutional complaint regarding a legal provision that allows the Military Criminal Act to be applied to crimes committed while a person was a minor.

The Constitutional Court announced on October 16 that three constitutional research officers, along with administrative officers, visited the Air Force Aviation High School yesterday afternoon to conduct an investigation session through methods such as interviewing students, faculty members, and guidance officers.

This session is part of the review for the unconstitutionality complaint regarding Article 92-3 of the Military Criminal Act.

The petitioner entered the Air Force Education and Training Command as a non-commissioned officer candidate, and after being appointed, served in the aircraft maintenance squadron of a combat wing's aviation security group.

The individual was indicted in a military court for the crime of indecent act by compulsion against military personnel due to acts committed during their minor years, and received a suspended prison sentence.

After the application for a constitutional review of the statute—which allowed the Military Criminal Act to apply to acts committed as a minor—was dismissed, the petitioner filed a constitutional complaint with the Constitutional Court in December 2023.

Investigation sessions conducted by constitutional research officers were first introduced in August 2018 during a constitutional complaint case concerning a provision of the Narcotics Control Act, making this the 15th such session to be held.
