EXO's CBX Wins Injunction Against Cha Ga-won's Label; Court Cites "Broken Trust"

EXO members Chen, Baekhyun, and Xiumin (collectively known as CBX) have won their injunction request filed against their agency, INB100, to suspend the validity of their exclusive contracts due to unpaid settlements.

On the 15th, the 50th Civil Division of the Seoul Central District Court (Presiding Judge Lee Sang-hoon) accepted the injunction request filed by CBX against INB100. As a result, the validity of the exclusive contracts will be suspended until the first-instance ruling on the main lawsuit confirming the non-existence of the exclusive contracts.

The court stated, "When revenue was generated from CBX's entertainment activities, INB100 had an obligation under the contract to pay settlement funds, but has failed to do so to date. Mutual trust has been broken due to INB100's attributable faults."

The court added, "The fundamental trust underlying the contract has collapsed, making it difficult to maintain a normal exclusive relationship any longer. If the main judgment regarding the validity of the contract is prolonged, CBX's independent entertainment activities will be significantly restricted during the remainder of the contract period." It further noted, "This goes beyond the simple economic aspects of a contractual relationship and risks seriously infringing upon CBX's constitutional fundamental rights, such as the freedom of occupational choice and freedom of activity."

Previously, CBX notified INB100 of the termination of their exclusive contracts in March and April due to reasons including unpaid contract fees and settlements. When the company did not respond, they filed an injunction to suspend the validity of the exclusive contracts along with a lawsuit confirming the non-existence of the exclusive contracts on the 18th of last month.

INB100 is a company established by Baekhyun in June 2023, and it was incorporated into One Hundred Label, led by CEO Cha Ga-won, in May of the following year. CEO Cha was detained and indicted in August on charges of fraud involving tens of billions of won, and her first trial is scheduled for the 13th of next month. Singers including Lee Seung-gi, Lee Moo-jin, and THE BOYZ have also successively notified the agency of the termination of their exclusive contracts, citing unpaid settlements and other reasons.
