Cho Kuk, head of the Innovation Policy Research Institute of the Rebuilding Korea Party, stated today (Sept. 1) regarding the Democratic Party's so-called special counsel bill on fabricated prosecutions, "To withdraw an indictment on the grounds of a 'fabricated prosecution,' the 'fabrication' must first be confirmed."

Writing on Facebook today, Director Cho stated, "If the withdrawal of the indictment against President Lee Jae-myung is pushed through while ignoring this, it will inevitably lead to political and legal setbacks."

Regarding the National Assembly's parliamentary investigation into fabricated prosecutions led by the Democratic Party, he pointed out, "There were many achievements. However, this alone is not enough," adding, "Evidence of 'fabrication' must be secured through inspections by the Ministry of Justice or the Supreme Prosecutors' Office, or through an investigation by the Corruption Investigation Office for High-ranking Officials (CIO)."

Mentioning the fact-finding investigation by the Ministry of Justice's Future Committee for Respecting Human Rights in Prosecution regarding the Daejang-dong and North Korea remittance cases, he noted, "We must also check these results," and added, "When Minister of Justice nominee Kim Seung-won takes office, swift and tangible results must be produced in this regard."

Regarding President Lee's trial on charges of violating the Public Official Election Act, Director Cho pointed out, "Under the law, an indictment can be withdrawn before the sentencing of the first-instance trial," and warned, "If a provision allowing the withdrawal of an indictment is included in the 'fabricated prosecution special counsel bill' for cases where trials are suspended while pending in the second instance during President Lee's presidency, problems will immediately arise."

He further argued, "The Democratic Party welcomed the guilty verdict against Yoon Suk Yeol for the crime of publishing false information under the Public Official Election Act," adding, "Unless the Supreme Court's legal principles are overturned again, there is a very high possibility that a guilty verdict will be handed down in the second-instance trial, which is set to resume after President Lee's term ends."

In addition, Director Cho said, "The abuse of power by the Yoon Suk Yeol prosecution was not limited to President Lee, as numerous officials from the Moon Jae-in administration were targeted for investigation, indicted, and are now being acquitted." He added, "Yet, the Democratic Party did not demand the withdrawal of indictments when these cases were in the first instance."
