Judge Lee Byeong-ho of Criminal Court Division 7 at the Changwon District Court announced today (Nov. 2) that a woman in her 40s, surnamed A, has been sentenced to six months in prison, suspended for two years, on charges of false accusation (perjury/false reporting) after falsely claiming she was raped following consensual sexual relations with a man.
A was put on trial on charges including submitting a false complaint to the Changwon Jungbu Police Station in Seongsan-gu, Changwon, Gyeongsangnam-do, on February 25, claiming that a man, surnamed B, had raped her inside a hotel room.
It was confirmed that A, who claimed to be a victim of sexual assault, had walked out of a hotel together with B on the morning of February 7—prior to submitting the complaint—and parted ways after waving goodbye to each other.
Furthermore, investigations showed that five days after parting ways, on February 12, A sent a text message to B saying, "Honey, cheer up today too."
On February 19 of the same month, she met with B, walked hand in hand, hugged, and kissed him.
In addition, considering that A provided detailed accounts during police questioning regarding the circumstances undering her entering the hotel with B, the court stated that it was difficult to view her as having been in a state of incapacity to resist due to extreme intoxication or psychological/physical coercion at the time.
Synthesizing these factors, the court ruled that A's charge of false accusation was established.
The bench pointed out that A placed B at risk of criminal punishment and improperly utilized the state's criminal justice system for personal gain. However, in explaining the sentencing rationale, the court noted that B, with whom she had reached an agreement, did not wish for her to be criminally punished, and that it was her first offense.
