The court has once again ruled in favor of Meritz Financial Group Chairman Cho Jung-ho in a legal battle with Booyoung Group Chairman Lee Joong-keun regarding the Han River view from their residences.
The 37-3 Civil Division of the Seoul High Court (Presiding Judges Park Eun-young, Kim Jong-ki, and Min Jung-seok) dismissed Chairman Lee's appeal on October 20 in the appellate trial for an injunction to suspend construction filed by Chairman Lee against Chairman Cho.
The court rejected Chairman Lee's request to halt the luxury housing construction project being carried out by Chairman Cho.
This lawsuit was filed in May on the grounds that the luxury house being built by Chairman Cho in Hannam-dong, Yongsan-gu, infringes upon the view rights of Chairman Lee's residence.
Chairman Lee's house is located directly behind the new house currently under construction by Chairman Cho.
The Seoul Western District Court, which handled the first instance of the injunction, dismissed Chairman Lee's application on July 27.
While the first instance noted that Chairman Cho's housing construction would impose some restrictions on the Han River view from Chairman Lee's residence, it pointed out that because Chairman Cho's house is situated diagonally from Chairman Lee's, the view would not be completely blocked.
The court also stated that there was no practical benefit to suspending construction since the structural work on the new house had already been completed.
In June, Chairman Lee's side also filed a lawsuit with the Seoul Administrative Court against the head of Yongsan-gu Office seeking to nullify the building permit issued for Chairman Cho's house, along with an application for a stay of execution.
With the Seoul Administrative Court having accepted Chairman Lee's application for a stay of execution on October 12, the effect of the building permit granted to Chairman Cho by Yongsan-gu Office remains suspended until April 11 of next year.
