Former Seoul Metropolitan Police Agency National Assembly Security Unit Chief Mok Hyun-tae, who was sentenced to prison in the first trial on charges of involvement in blockading the National Assembly during the December 3 emergency martial law, will undergo trial without detention.

According to the legal community on October 13, Criminal Division 12-1 of the Seoul High Court (Presiding Judges Lee Seung-chul, Cho Jin-gu, and Kim Min-a) granted Mok's request for bail on this day.

Bail is a procedure in which the court lifts the detention of a defendant on trial by imposing the payment of a deposit or other appropriate conditions.

Mok filed for bail with the appellate court on October 6.

During the bail hearing held the previous day, Mok's legal team argued that they are not heavily disputing the charges and that there is no risk of flight.

In granting bail, the court imposed conditions such as restricting his residence and prohibiting contact or communication with individuals related to the case.

Mok was put on trial on charges of instructing on-duty officers of the National Assembly Security Unit to bar all civilians, including lawmakers, from entering the National Assembly following the declaration of emergency martial law.

The first-instance court determined that Mok, acting under the instructions of former Seoul Metropolitan Police Agency Chief Kim Bong-shik, ignored requests for entry by the National Assembly Speaker and others, and obstructed lawmakers from exercising their deliberation and voting rights, sentencing him to three years in prison and detaining him in court.

Following the first-instance sentencing, Mok was dismissed from his position along with former Chief Kim Bong-shik.
