It has been confirmed that Coupang, which previously objected to an on-site inspection by the Fair Trade Commission (FTC), has now filed for an injunction against the FTC's order to report and submit materials.
According to the legal community on October 7, Coupang filed an injunction with the Seoul High Court on September 30 requesting a suspension of the effectiveness of the FTC's order to report and submit data.
The court is scheduled to hold a hearing on Coupang's injunction application on November 5.
This application is known to be related to the submission of materials requested by the FTC from Coupang last month.
Previously in August, the FTC attempted to conduct an on-site inspection to verify suspicions that Coupang violated the Large-Scale Retail Business Act, but Coupang refused on the grounds that it had not received written notice, preventing the inspection.
Subsequently, the FTC dispatched about 30 investigators to Coupang's headquarters on September 1 to conduct an on-site inspection under allegations of Fair Trade Act violations, which do not carry a written notification obligation.
At that time, the FTC reportedly requested data spanning about 10 years, starting from 2016.
Coupang's stance is reportedly that it has already been investigated by the FTC multiple times and was subjected to excessive demands for data submissions in a situation where the allegations are not clear.
Previously, Coupang filed an injunction objecting to the decision to conduct an on-site inspection regarding suspicions of violating the Large-Scale Retail Business Act, but the court dismissed it on September 23.
