A man in his 60s who swung a paper bag containing a liquor bottle at a police officer while heavily intoxicated, causing injuries, has been sentenced to prison again in his appellate trial.

According to the legal community, the 14th Criminal Division of the Suwon High Court (Presiding High Court Judge Hur Yang-yoon) dismissed the appeal of a defendant identified as A, who was indicted on charges of special obstruction of official duties resulting in injury, upholding the lower court's sentence of 1 year and 6 months in prison.

A was put on trial for swinging a paper bag containing an empty liquor bottle at the face of Police Officer B at a police box in Jungwon-gu, Seongnam-si, at around 10:40 PM on September 24 of last year, inflicting injuries.

At the time, A went to the police box while intoxicated and demanded that the owner of a local pub be punished. When Police Officer B advised him to go home, A used inappropriate language and committed the crime.

During the incident, Police Officer B sustained injuries requiring about 20 days of medical treatment, including a partial rupture of the jaw muscle.

The first-instance court stated that the crime neutralized the legitimate exercise of public authority and threatened the safety of public officials, necessitating strict punishment. It added that the defendant was subject to severe criticism given his prior record of punishment for similar offenses.

The court also explained its sentencing reasons by taking into account mitigating factors, such as the defendant admitting to the crime.

The appellate court similarly dismissed the appeal, explaining that the lower court's sentence appeared to have been appropriately determined by considering various circumstances and that the sentence was not unfairly excessive.
