A man in his 60s working as a child safety guard, who was put on trial for indecently assaulting a child while pushing a swing, has been sentenced to a prison term with probation.
The Jeju District Court Criminal Division 2 sentenced the defendant in his 60s, identified as A, who was indicted without detention on charges of violating the Act on Special Cases Concerning the Punishment of Sexual Crimes, to two years and six months in prison, suspended for four years.
The court also ordered probation, completion of 80 hours of a sexual violence treatment program, and a 10-year employment ban at child, youth, and welfare facilities for the disabled.
A was indicted on charges of indecently assaulting a child, such as touching the child's buttocks while pushing a swing on April 14 of last year.
A denied the charges, claiming that while he did push the swing, he never touched the child's buttocks, and that even if his hand came into contact, it was inevitable physical contact that occurred while pushing the swing and did not constitute an indecent act.
However, the court explained that based on the victimized child's statement and closed-circuit television footage, it could be recognized that A's hand moved near the child's buttocks in a manner different from ordinary swing pushing.
The court also noted that A had received training while working as a child safety guard stating that physical contact with children could be subject to criminal punishment, adding that even conditional intent for the indecent act could be recognized.
