Judge Park Kwang-min of Criminal Division 1 at the Cheongju District Court sentenced a man in his 50s, identified as A, to a fine of 3 million won for secretly entering someone else's house to defecate after experiencing a sudden stomach ache.
According to the legal community on September 6, Defendant A was indicted on charges of trespassing (violation of residence) after cutting across the yard of a detached house in Boeun-eup, Boeun-gun, Chungcheongbuk-do, and defecating in front of the boiler room at 3:50 p.m. on December 31 of last year.
Investigations revealed that Defendant A committed the act after driving to the area to meet his family, when he was suddenly overcome with severe stomach pain.
The homeowner discovered the feces covered with toilet paper, checked the CCTV footage, and reported the incident.
Defendant A, who had previously served a 7-year prison term for robbery and injury under the Act on the Aggravated Punishment, etc. of Specific Crimes and was released in October of last year, violated a probation order prohibiting alcohol consumption. Consequently, he was sentenced to 10 months in prison and was re-incarcerated in April of this year, where he is currently serving his sentence.
Judge Park stated, "The sentence was determined by taking into consideration the defendant's motive for the crime and the circumstances following the offense."
