A U.S. federal district court granted a preliminary injunction on the 2nd (local time) halting the enforcement of Donald Trump's executive order restricting "birth tourism" aimed at acquiring U.S. citizenship, U.S. political outlet The Hill reported.
According to the reports, U.S. District Judge Deborah Boardman in Maryland accepted the preliminary injunction filed by immigrant support groups, citing the U.S. Supreme Court's ruling in June of this year.
In her ruling, Judge Boardman stated, "We once again order a stay of enforcement against the president's recent attempt to strip citizenship from children born to parents unlawfully residing in the United States."
With this ruling, the U.S. administration is temporarily barred from stripping U.S. citizenship from children born after February 19, 2025, to one or both parents who were in the country unlawfully.
On his first day in office last year, President Trump issued an executive order restricting birthright citizenship guaranteed by the 14th Amendment, but the U.S. Supreme Court invalidated it in June of this year.
Refusing to effectively accept this, President Trump signed two new executive orders in July containing measures such as banning entry for the purpose of giving birth in the U.S.
In response, immigrant advocacy groups filed for a preliminary injunction with the U.S. District Court for the District of Maryland to halt the implementation of these executive orders.
While Maryland is where the plaintiff organizations are located, The Hill noted that Judge Boardman was appointed by former President Joe Biden.
The U.S. Department of Justice argued that the plaintiffs' injunction request was invalid because the two new executive orders have a narrower scope than the first and have not yet gone into effect, but the court rejected the argument.
