The 2nd Comprehensive Special Counsel team announced that it has dismissed the case against Supreme Court Chief Justice Cho Hee-dae, who had been accused of involvement in the December 3 emergency martial law on the 20th of last month.
Chief Justice Cho had been accused on the grounds that, as the head of the judiciary at the time of the declaration of the December 3 emergency martial law, he was complicit in the insurrection by failing to point out the unconstitutionality and illegality of the martial law or to take action to block it.
Accordingly, the comprehensive special counsel explained that although it conducted an investigation of the complainant, no new facts were confirmed, leading to the dismissal of the case.
Previously, the special counsel team on insurrection also decided not to indict Chief Justice Cho on insurrection charges.
According to the non-indictment decision document drafted by the special counsel team on insurrection, Chief Justice Cho arrived at the National Court Administration at around 0:40 a.m. on December 4, 2024, stated at a gathering of executives that the emergency martial law was unconstitutional, and instructed officials not to dispatch liaison officers when receiving a report that the martial law command had requested such a dispatch.
