A man in his 40s who attempted to murder a woman in her 20s he knew by beating her with an aluminum pipe has had his prison sentence commuted to a suspended term on appeal.

According to legal circles today (August 22), the Suwon High Court Criminal Division 2 (Presiding Judge Kim Gun-woo) overturned the lower court's ruling that sentenced Defendant A to three years in prison for attempted murder, instead sentencing him to three years in prison suspended for five years.

Additionally, the court ordered three years of probation and 80 hours of community service.

Defendant A was indicted for attempting to murder Victim B, a woman in her 20s, by striking her head and face about 30 times with a 59-centimeter-long aluminum mop handle and other objects on a road in Daedeok-myeon, Anseong-si, Gyeonggi-do, around 7:36 PM on November 6 of last year.

Investigations revealed that even after the pipe broke, he continued to assault Victim B with his fists and feet as she lay on the ground, inflicting injuries that required two weeks of medical treatment.

The two were acquaintances who exchanged messages and argued over a bar tab dispute. As the emotional conflict escalated with mutual insults regarding each other's families, Defendant A harbored a grudge and committed the crime.

The first-instance court previously sentenced Defendant A to three years in prison, stating that the crime was brutal and grave in nature, noting that he continued his attacks even after the victim lost the ability to defend herself.

However, the appellate court overturned the lower court's prison sentence and reduced the penalty to a suspended sentence.

The appellate court stated the reasons for reduction, noting that while the crime was indeed grave considering the method and motive, the defendant has fully admitted to the crime and shown remorse through the first and appellate trials, and most importantly, reached a settlement with the victim, who expressed her wish not to have the defendant punished.

The court added that considering all sentencing conditions—including that the defendant has no prior record of the same type of crime, has no criminal record other than a single past fine, and has shown remorse while being detained for about eight months due to this case—the sentence rendered by the lower court was excessively heavy and unfair.

Meanwhile, during the appellate proceedings, Defendant A mentioned a past diagnosis of panic disorder and argued for mental and physical weakness caused by an overdose of neuropsychiatric medication as grounds for mitigation, but the court rejected this, stating it was difficult to view him as having lacked the ability to discern things at the time.
