The property division amount recognized for Director Roh Soh-yeong by the remand appellate court yesterday (July 24) stands at KRW 944 billion. The decisive factor was the court's judgment that SK shares held by Chairman Chey Tae-won constitute joint property formed and maintained by the couple together.

Last October, the Supreme Court partly reversed the appellate court ruling on the divorce lawsuit between SK Group Chairman Chey Tae-won and Art Center Nabi Director Roh Soh-yeong, specifically regarding the property division portion.
There were two main reasons.
First, the approximately KRW 30 billion gifted by Director Roh's father, Noh Tae-woo, to Chairman Chey's side was illegal funds and could not be seen as Director Roh's contribution to property formation. Second, assets gifted by Chairman Chey to relatives and others before the breakdown of the marital relationship were not subject to division.
Reflecting the Supreme Court's ruling, the remand appellate court stated that Noh Tae-woo's gift would not be considered in calculating the property division ratio, and also excluded assets gifted by Chairman Chey to third parties prior to the breakdown of the marriage from the division scope.
Nevertheless, the remand appellate court ruled that the property division amount for Director Roh amounts to KRW 944 billion.
The decisive factor was the judgment that SK shares and other stocks held by Chairman Chey were subject to division.
The court stated that even if Noh Tae-woo's gift is not evaluated as a contribution by Director Roh's side, the shares held by Chairman Chey were acquired under Chairman Chey's name during the marriage, and both individuals are recognized as having contributed to their formation, value maintenance, and enhancement.
Accordingly, the court calculated Director Roh's share at 1/3, or approximately 33.3%, of the total, which is only a slight decrease from the 35% set by the second-instance trial.
Given that the second-instance court determined the ratio by judging Noh Tae-woo's gift as a contribution to be considered in property division, this remand ruling is interpreted as concluding that removing that portion does not cause a significant difference in the division ratio.
