The agency of the group FIFTY FIFTY, ATTRAKT, has lost a copyright lawsuit over their global hit song 'Cupid'.
Recently, the Seoul Central District Court's 62nd Civil Agreement Division (Chief Judge Lee Hyun-seok) ruled in favor of The Givers, an outsourcing company, in a copyright confirmation lawsuit filed by ATTRAKT, which claimed ownership of the copyright for 'Cupid'.
The court stated, "The actual actions of contract signing, negotiation, and cost bearing were carried out through The Givers, indicating that The Givers holds the creative rights. The objective meaning of the text in the copyright transfer agreement clearly indicates The Givers as the party involved."
Previously, ATTRAKT had filed a lawsuit seeking confirmation that they held the rights to reproduce, perform, transmit to the public, exhibit, distribute, lend, and create derivative works of 'Cupid', and requested that The Givers be ordered to cancel their copyright claim on 'Cupid'.
In response, ATTRAKT announced on the 9th that they are "currently reviewing legal aspects and preparing to appeal."
'Cupid' by FIFTY FIFTY, released in February 2023, climbed to 17th place on the US Billboard Hot 100 singles chart and remained on the chart for a total of 25 weeks, enjoying significant popularity.
ATTRAKT has been in a legal battle following allegations of tampering by The Givers' CEO An Sung-il in 2023, which involved premature contact with FIFTY FIFTY before their contract expired.
